Welcome to Canada Pardon Services Inc. (CPS). These Terms and Conditions form a binding agreement between you (the "Client" or "Consumer") and CPS for services related to assisting with applications for a Canadian Pardon (Record Suspension) from the National Parole Board (NPB) and/or a U.S. Entry Waiver from the U.S. Department of Homeland Security (DHS). By submitting an online application, providing payment information, or using our services, you confirm that you have read, understood, and agree to these terms. If you do not agree, do not proceed with the application.
CPS assists clients by gathering and preparing documents for submission to the relevant government agencies but does not provide legal advice. CPS acts on your behalf for the Canadian Pardon application with the NPB. For the U.S. Entry Waiver, you are responsible for submitting the final application to U.S. Customs and Border Protection (CBP). CPS has no control over government decisions, timelines, or outcomes, and success is not guaranteed.
These terms comply with the Ontario Consumer Protection Act, 2002 (CPA), and nothing herein waives your statutory rights under the CPA or other applicable laws.
1. Services Description
CPS provides the following services (selected by you during application):
- Canadian Pardon (Record Suspension): Collecting fingerprints, police records, court documents, reference letters, and other required information; preparing and submitting the application to the NPB on your behalf.
- U.S. Entry Waiver: Assisting with document collection and preparation; you must submit the application to DHS/CBP yourself.
- Both Services: As above, for both applications.
- Record Destruction: Assistance where applicable, subject to eligibility.
The process involves interactions with agencies such as the RCMP, local police, courts, NPB, and DHS. You must provide accurate information, fingerprints, valid ID (e.g., passport, driver's license), reference letters, and details about charges. You must continue complying with the law during the process; any new offenses may affect eligibility, timelines, or outcomes.
Timelines are estimates only and depend on factors outside CPS's control (e.g., agency backlogs, offense details):
- RCMP results: Up to 120+ days.
- Court documents: 3+ months.
- Local police checks: Up to 6 months.
- Overall process: Up to 24 months.
CPS will use reasonable efforts to complete its internal processing promptly, but external delays are not CPS's responsibility.
2. Fees and Payment
- Service Fees: $548.05 (tax included) per service (Pardon or Waiver; $1,096.10 for both). This covers document collection, preparation, and submission assistance. Fees may increase based on the nature/number of charges (e.g., complex cases); any increase will be quoted in advance for your approval. These fees do not include government processing fees: $50 to the Receiver General of Canada (NPB) and/or US$1100 to DHS (subject to change by those agencies).
- Additional Costs: You are responsible for costs like fingerprinting, postage, or agency fees. Client-caused delays (e.g., incomplete information) may incur reasonable additional fees, quoted in advance; no charge will exceed any estimate by more than 10% without your consent.
- Payment Options:
- Full payment upfront.
- Instalment plan: $182.68 per month per service for 3 months (total $548.05 per service). Payments are due on the agreed dates. Late payments may incur interest at [reasonable rate, e.g., 1.5% per month], but no excessive penalties. If payments are missed, CPS may require the balance, but you retain CPA rights to dispute or cancel if applicable.
- Payment Methods: Secure credit card (via SSL-encrypted system), phone, or check/money order. Government fees are payable separately as directed.
- Total Amount Payable: [Itemized in your confirmation email, e.g., Service Fee: $548.05; Government Fees: $50; Total Estimated: $598.05 (excluding extras)].
- All fees are in CAD. Refunds, where applicable, will be processed to your original payment method within 15 days (credit card: up to 5 business days; check: mailed via Canada Post).
3. Client Responsibilities and Consent
By applying, you consent to CPS communicating with relevant agencies (e.g., RCMP, police, courts, NPB, DHS) to obtain documents and complete your file. You must provide complete, accurate information promptly. Failure to do so may delay the process and incur additional costs (quoted in advance).
You are responsible for shipping documents via registered post; CPS is not liable for loss in transit unless due to our negligence.
4. Cancellation Rights
You have the following cancellation rights under the CPA (in addition to any other legal rights):
- 7-Day Period: You may cancel without reason or penalty within 7 days after receiving a copy of this agreement if CPS did not provide required pre-agreement disclosures or obtain your express consent.
- 30-Day Period: You may cancel within 30 days if CPS fails to deliver a compliant copy of this agreement.
- 1-Year Period for Non-Compliance: You may cancel within 1 year if the agreement copy is not compliant with CPA requirements.
- Unfair Practices: You may rescind within 1 year if the agreement involves an unfair practice (e.g., misleading representations).
- Late Performance: You may cancel before services begin if CPS fails to perform by an agreed date (extended by 30 days).
To cancel, provide notice in any reasonable manner (e.g., email to apply@pardoncanadaservice.ca, phone, mail, or our cancellation form). Upon cancellation, CPS will refund payments (less reasonable compensation for services already provided, e.g., initial file setup up to $182.68 per service if applicable) within 15 days. No refunds for government fees already paid to agencies.
Cancellations are processed within 48 hours of receipt. If cancelling after services start, you may request return of your documents at your expense before file deletion.
5. Refunds
Refunds are provided as per your CPA rights:
- Full refund (less reasonable compensation) upon valid cancellation.
- No refunds for services fully completed or government rejections/delays beyond CPS's control.
- If you demand a refund for illegal charges under the CPA, it will be provided within 15 days.
After 48 hours, refunds are not automatic but available if statutory rights apply. Files inactive for 2+ years may be closed without refund.
6. Liability and Warranties
CPS will provide services with reasonable care and skill, in line with acceptable quality standards. We are not liable for:
- Government decisions, delays, or rejections (e.g., RCMP/court timelines).
- Document loss in transit (recommend registered mail).
- Your non-compliance with laws or provision of inaccurate information.
However, CPS remains liable for negligence, willful misconduct, or CPA violations. You may seek remedies (e.g., damages) under the CPA if services do not meet standards.
7. Privacy and Data Protection
CPS is committed to protecting your personal information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other laws. We use secure systems for data handling. In case of errors, we will remedy as reasonably possible. You consent to data sharing with agencies as needed for services.
8. Secure Payment and Site Terms
Payments are processed securely via SSL (https://). By using the site, you agree to these terms, which may be updated (notified via email/site). If changes are material, you may cancel without penalty.
9. Governing Law and Dispute Resolution
This agreement is governed by Ontario law. Disputes may be resolved via negotiation, mediation, or Superior Court of Justice (as per CPA s. 100). No arbitration clauses restrict your court access.
